Terms of Service

1. Introduction and acceptance

These Terms of Service (the "Terms") are a binding agreement between you and HearSay Learn B.V., a Dutch private limited company registered at Nieuwe Achtergracht 184, 1018WV Amsterdam, the Netherlands, with the Dutch Chamber of Commerce (Kamer van Koophandel) under number 98853244 ("HearSay," "we," "us").

HearSay is an AI-powered language learning service delivered primarily through WhatsApp, with a companion web flow for onboarding and account management. Together we call this the "Service".

By starting a conversation with HearSay on WhatsApp, scanning a HearSay QR code, or purchasing a subscription, you accept these Terms. If you do not accept them, please do not use the Service.

2. Age requirement

The Service is intended for users aged 18 or older. By using HearSay you confirm that you are at least 18. We do not knowingly collect data from anyone under 18. If you believe a minor has used the Service, please contact us at team@hearsaylearn.com and we will remove their data.

3. Subscriptions and billing

HearSay is offered as a paid subscription. We currently offer monthly, yearly, and lifetime plans. Prices, taxes, and currency are shown at checkout. Payments are processed by Stripe.

  • Monthly and yearly subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time; the cancellation takes effect at the end of the current period. To avoid the next renewal, cancel at least 24 hours before the renewal date.
  • Lifetime subscriptions give you access for as long as we continue to operate the language course and platform you purchased. We may discontinue specific languages, retire a delivery platform (for example WhatsApp), or wind down the Service entirely with reasonable notice. If we discontinue the Service entirely within three years of your lifetime purchase, you may be entitled to a pro-rated refund.

You are responsible for keeping your payment method up to date. If a payment fails, we may suspend your access until the issue is resolved.

4. Refunds and the 14-day guarantee

HearSay delivers digital content immediately after purchase. By starting your subscription you ask us to begin delivery right away, and you agree that this waives the standard 14-day EU statutory right of withdrawal once we have started delivering lessons.

On top of that, we offer a voluntary 14-day money-back guarantee: if you are not happy with HearSay within 14 days of your first purchase, email team@hearsaylearn.com or message us on WhatsApp and we will refund you in full.

Renewal payments are not covered by the 14-day guarantee. If a renewal charge is unexpected, contact us and we will look at it case by case.

5. AI-generated content

Lessons, dialogues, corrections, and feedback in HearSay are generated by large language models. We do not guarantee that AI-generated content is linguistically perfect, factually accurate, or culturally appropriate in every situation. The AI can produce mistakes.

HearSay is a learning tool, not a substitute for professional advice, certified translation, or formal qualification. We are not liable for losses caused by relying on AI-generated content for decisions that require professional or legal accuracy.

6. Fair use

HearSay is designed for human language learning. We may throttle, limit, or suspend accounts that generate unusual traffic — for example automated scripts, bot activity, or message volume that goes well beyond what a person learning a language would send — when it places a disproportionate load on our infrastructure or AI providers.

7. Intellectual property

The HearSay software, models, lesson content, brand, name, and visual identity belong to HearSay Learn B.V. and its licensors. Your subscription gives you a personal, non-exclusive, non-transferable right to use the Service for your own language learning. You may not copy, resell, reverse-engineer, or systematically extract content from HearSay.

8. Third-party platforms

HearSay runs on top of services operated by other companies — including Meta (for WhatsApp delivery), Cloudflare (for hosting and storage), Google, OpenRouter, and LiveKit (for AI and voice). If any of these services have an outage, change their terms, or block our account, parts of HearSay may be unavailable. We are not responsible for outages or actions taken by these third parties, and we cannot guarantee uninterrupted service.

Your use of HearSay via WhatsApp is also governed by WhatsApp's own terms. Please use HearSay in line with those terms — in particular, do not use the Service in a way that could get our WhatsApp Business account suspended (for example, spam, harassment, or sharing illegal content).

9. Limitation of liability

To the maximum extent permitted by Dutch law, HearSay is not liable for indirect, incidental, special, consequential, or punitive damages, lost profits, or lost revenue arising from your use of the Service.

Our total aggregate liability to you, for any claim arising out of or relating to the Service or these Terms, will not exceed the greater of (a) one hundred euros (€100) or (b) the total amount you have paid HearSay in the twelve months preceding the claim. Nothing in these Terms limits any liability that cannot be limited under Dutch consumer law.

10. Governing law and disputes

These Terms are governed by the laws of the Netherlands. Any dispute arising out of or in connection with the Service or these Terms will be submitted to the exclusive jurisdiction of the competent court in Amsterdam, the Netherlands. As a consumer, you may also have the right to bring a claim in the courts of your country of residence under applicable EU consumer law.

11. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top and, where the change affects you directly (for example, a change to billing or refund rights), we will notify you by email or by message on WhatsApp before the change takes effect. Continued use of the Service after the change takes effect means you accept the updated Terms.

These Terms are published in English. We may publish translations for convenience, but in case of any difference between the English version and a translation, the English version prevails.
